Terms of Service

1.Acceptance of Terms

By downloading, installing, accessing, or using Bodydex ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

Bodydex is operated by Daniel Bobunov ("we," "us," or "our"), an individual developer. These Terms constitute a legally binding agreement between you ("you" or "User") and Daniel Bobunov governing your use of the App and related services.

Your continued use of the App following any changes to these Terms constitutes your acceptance of such changes.

2.Service Description

Bodydex is a nutrition tracking, food logging, and lifestyle management application. The App provides, but is not limited to, the following features:

• Manual food logging with calorie and macronutrient tracking
• Barcode scanning for packaged food products
• AI-powered food photo analysis for nutritional estimation
• AI nutrition coaching and conversational guidance
• Voice-assisted food logging
• Medication, supplement, and protocol adherence tracking
• Peptide reconstitution calculator
• Weight logging, body measurement tracking, and progress photos
• Nutrition target calculations based on established scientific formulas
• Integration with Apple HealthKit and Google Health Connect
• Exercise and workout logging
• Recipe creation and management
• Data export capabilities

Feature availability may vary based on your subscription tier and may change over time as we improve the App.

3.Eligibility

You must be at least 13 years of ageto use this App, in compliance with the Children's Online Privacy Protection Act (COPPA). If you are between the ages of 13 and 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the App, you represent and warrant that you meet the above age requirements and that you have the legal capacity to enter into these Terms.

4.User Accounts

You may create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to:

• Provide accurate and truthful information when creating your account
• Maintain only one personal account
• Not share your account credentials with any third party
• Notify us immediately of any unauthorized use of your account

You are solely responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

5.Subscription Terms

5.1 Service Tiers

Bodydex Free includes manual food logging, barcode scanning, nutrition target calculations, medication and supplement tracking, basic analytics, and calendar view.

Bodydex Pro additionally includes AI meal photo scans (limited daily uses), advanced analytics and insights, data export features, protocol management tools, and priority access to new features. Available as monthly, yearly, or one-time lifetime purchase.

Bodydex AI additionally includes expanded AI meal photo scans, an AI-powered nutrition coach, AI-driven daily nutritional analysis, and voice-assisted food logging. Available as monthly or yearly subscription only.

5.2 Billing & Auto-Renewal

Subscriptions are billed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You may manage your subscription and turn off auto-renewal by going to your device's Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5.3 Refunds

Refund requests are handled in accordance with Apple App Store and Google Play Store policies. We do not directly process refunds. For refund inquiries, please contact Apple or Google support through the respective app store.

6.Acceptable Use

You agree NOT to:

• Use the App as a substitute for professional medical advice, diagnosis, or treatment
• Rely solely on AI-generated nutritional estimates for managing serious health conditions
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Circumvent, disable, or interfere with security features or premium feature restrictions
• Attempt to gain unauthorized access to any systems or infrastructure connected to the App
• Use the App to transmit harmful, offensive, or illegal content
• Share your account credentials with others or allow multiple people to use a single account
• Use automated means to access or interact with the App (bots, scrapers, etc.)

7.Health & Medical Disclaimer

You acknowledge and agree that:

• No Medical Advice: Nothing in the App constitutes medical advice, diagnosis, or treatment. All calorie calculations, macro targets, and nutritional estimates are based on general formulas (such as Mifflin-St Jeor) and are approximations only. Individual results may vary.
• Consult Professionals: You should always consult a qualified healthcare professional, licensed dietitian, or physician before starting any new diet, exercise program, supplement regimen, or making changes to your medication.
• AI Limitations: AI-powered food analysis provides estimates only. Accuracy depends on image quality, food presentation, portion sizing, and model capabilities. AI-generated suggestions are not a substitute for professional nutritional counseling.
• User Responsibility: You are solely responsible for all health decisions made in connection with information obtained from the App.
• Not for Emergencies: The App is not intended for use in medical emergencies. If you experience a medical emergency, call your local emergency services immediately.

8.Protocol, Medication & Supplement Tracking Disclaimer

You acknowledge and agree that:

• No Endorsement of Substances: The inclusion, listing, or tracking of any medication, supplement, peptide, or other substance within the App does NOT constitute an endorsement, recommendation, or validation of that substance by Bodydex or its developer.
• Peptide Calculator: The peptide reconstitution calculator is a mathematical unit-conversion tool only. It performs arithmetic calculations based on values you provide (vial quantity, water volume, desired dose). It does NOT provide medical instruction, injection training, or dosing guidance. Any instructional text displayed is general reference information only.
• User Responsibility: You are solely responsible for ensuring that any substances you track are legal in your jurisdiction, used in accordance with applicable laws and regulations, and administered under the supervision of a licensed healthcare provider.
• No Drug Interaction Checks: The App does NOT verify drug interactions, contraindications, allergies, or dosage safety. You must consult your healthcare provider and pharmacist for all drug interaction and safety information.
• No Liability: The developer is NOT liable for any adverse health outcomes resulting from self-administration of any substance tracked or calculated using the App.

9.AI Features Disclaimer

Bodydex utilizes artificial intelligence services for certain features including food photo analysis, nutritional coaching, daily analysis, and voice-assisted food logging. You acknowledge and agree that:

• Estimates Only: All AI-generated nutritional information (calories, macronutrients, portion sizes) are estimates and approximations. They should NOT be relied upon as exact values.
• Transient Processing: Food photos and text submitted for AI analysis are processed by our secure server infrastructure and then immediately discarded. We do NOT store your food photos on our servers.
• AI Training Disclosure: On the free tier, AI-processed food images may be used by our AI service providers for model improvement purposes in accordance with their respective terms. No personally identifiable information (names, faces, location data) is included with these submissions — only food imagery and nutritional prompts. Paid subscribers benefit from enhanced privacy controls that prevent the use of their data for AI model training.
• No Personal Data in AI Requests: AI processing requests contain only the data necessary for the specific analysis (e.g., a food photo, a short text query, or anonymized nutritional context). No full user profiles, email addresses, or identifying information are transmitted to AI service providers.
• Service Availability: AI features require an active internet connection and are subject to third-party service availability. We do not guarantee uninterrupted access to AI features.

10.Data Accuracy & Third-Party Data Sources

Nutritional data within the App is sourced from third-party providers and databases. While we strive for accuracy, we do not independently verify all nutritional data and cannot guarantee that it is complete, accurate, or up to date.

You acknowledge that nutritional data from the following sources may contain inaccuracies:

• FatSecret Platform API — Bodydex is powered by data from the FatSecret Platform API. Use of FatSecret data is subject to the FatSecret Terms of Use.
• USDA FoodData Central — Government-provided nutritional reference data (public domain).
• Open Food Facts — Community-contributed food database used under the Open Database License (ODbL).

You should independently verify critical dietary information, particularly if you have food allergies, intolerances, or medical conditions that require precise nutritional management.

11.Intellectual Property

All content, features, functionality, design, code, trademarks, and visual elements of the App (excluding user-generated content and third-party data) are the exclusive property of Daniel Bobunov and are protected by applicable intellectual property laws.

Third-party data sources (USDA, Open Food Facts, FatSecret) are used under their respective licenses and remain the property of their respective owners.

12.User-Generated Content

You retain full ownership of all content you create within the App, including but not limited to: recipes, food log notes, weight log notes, custom exercises, and any other user-entered data.

We do not claim any ownership rights over your content. Your user-generated content is stored locally on your device and is not shared with, transmitted to, or accessed by us or any third party unless you explicitly initiate such action (e.g., using AI analysis features).

13.Feedback & Suggestions

If you provide us with any feedback, suggestions, ideas, or feature requests ("Feedback"), you acknowledge that such Feedback is provided voluntarily and becomes our property. We may use, modify, and implement Feedback without restriction, attribution, or compensation. You waive any and all rights you may have in or to such Feedback.

14.Limitation of Liability

To the maximum extent permitted by applicable law:

• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• In no event shall Daniel Bobunov be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or health outcomes, arising from your use of or inability to use the App.
• Our total aggregate liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you have paid to us in subscription fees in the twelve (12) months prior to the event giving rise to the claim, or fifty US dollars ($50.00), whichever is greater.

We are not liable for inaccuracies in nutritional data provided by third-party sources, health outcomes from following app-generated targets, data loss due to device failure, or service interruptions due to causes beyond our reasonable control.

15.Indemnification

You agree to indemnify, defend, and hold harmless Daniel Bobunov and any affiliated parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your reliance on any information provided by the App for health decisions
• Any health outcomes resulting from diets, exercise, medication, supplement, or peptide use tracked or calculated using the App
• Your violation of any applicable law or the rights of any third party
• Any content, data, or information you submit to or through the App

16.Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or infrastructure outages, third-party API provider downtime, power failures, cyberattacks, pandemics, or other force majeure events.

As an individually operated service, we will make commercially reasonable efforts to restore functionality following any such event, but cannot guarantee specific timelines for resolution.

17.Dispute Resolution & Arbitration

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles.

17.2 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at legal@bodydex.app and attempt to resolve the dispute informally for at least thirty (30) days.

17.3 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA) or a comparable arbitration body.

17.4 Class Action Waiver

17.5 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

18.Apple App Store & Google Play Store Terms

18.1 Apple App Store

If you access the App through the Apple App Store, the following additional terms apply:

• These Terms are between you and Daniel Bobunov only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• The license granted to you for the App is limited to a non-transferable right to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the App.
• Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Apple shall not be responsible for the investigation, defense, settlement, or discharge of such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18.2 Google Play Store

If you access the App through the Google Play Store, you acknowledge that Google LLC is not a party to these Terms and has no responsibility or liability for the App. In the event of a conflict between these Terms and the Google Play Developer Distribution Agreement, the Google Play Developer Distribution Agreement shall prevail.

18.3 Subscription Billing

All subscription purchases and in-app transactions are processed through the respective app store (Apple or Google). We do not have access to your payment information (credit card numbers, billing addresses). Payment disputes should be directed to the respective app store.

19.Electronic Communications

By using the App and enabling push notifications, you consent to receiving electronic communications from us, including but not limited to:

• Medication, supplement, and meal logging reminders (user-configured)
• Important service announcements and updates
• In-app notifications regarding your account or subscription

You may disable push notifications at any time through your device settings.

20.Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.

You may stop using the App at any time. You may delete your account and all associated data at any time through the App's settings (Profile → Delete All Data). Upon deletion, all locally stored data is permanently and irreversibly removed from your device.

21.Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. It is your responsibility to review these Terms periodically for changes.

Your continued use of the App after any modifications to these Terms constitutes your acceptance of the modified Terms.

22.General Provisions

22.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

22.3 Assignment

We may assign or transfer our rights and obligations under these Terms without restriction (including in connection with the formation of a business entity or sale of assets). You may not assign or transfer your rights under these Terms without our prior written consent.

22.4 Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription terms, constitute the entire agreement between you and Daniel Bobunov regarding your use of the App.
