Terms of Service

1.Acceptance of Terms

By downloading, installing, accessing, or using BodyDex ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

BodyDex is operated by Daniel Bobunov ("we," "us," or "our"), an individual developer. These Terms constitute a legally binding agreement between you ("you" or "User") and Daniel Bobunov governing your use of the App and related services.

Your continued use of the App following any changes to these Terms constitutes your acceptance of such changes.

2.Service Description

BodyDex is a nutrition tracking, food logging, and lifestyle management application. The App provides, but is not limited to, the following features:

• Manual food logging with calorie and macronutrient tracking
• Barcode scanning for packaged food products
• AI-powered food photo analysis for nutritional estimation
• AI nutrition coaching and conversational guidance
• Voice-assisted food logging
• Medication, supplement, and protocol adherence tracking
• Peptide reconstitution calculator
• Weight logging, body measurement tracking, and progress photos
• Nutrition target calculations based on established scientific formulas
• Integration with Apple HealthKit and Google Health Connect
• Exercise and workout logging
• Recipe creation and management
• Data export capabilities

Feature availability may vary based on your subscription tier and may change over time as we improve the App.

3.Eligibility

BodyDex is not intended for children under 13 years of age, and you must be at least 13 to use this App. If you are between the ages of 13 and 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Additional age and parental-authorization requirements apply where required by the law that applies to you.

By using the App, you represent and warrant that you meet the above age requirements and that you have the legal capacity to enter into these Terms.

4.User Accounts

You may create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to:

• Provide accurate and truthful information when creating your account
• Maintain only one personal account
• Not share your account credentials with any third party
• Notify us immediately of any unauthorized use of your account

You are solely responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

5.Subscription Terms

5.1 Service Tiers

BodyDex Free includes manual food logging, barcode scanning, nutrition target calculations, medication and supplement tracking with a limited number of active protocols, data export, basic analytics, and calendar view.

BodyDex Premium additionally includes AI meal photo scans (limited daily uses), the AI-powered nutrition coach, AI-driven nutritional analysis, voice-assisted food logging, expanded video recipe imports, unlimited active protocols, advanced analytics and insights, and priority access to new features. Available as a monthly or yearly subscription; an introductory trial may be offered. Current pricing and included features are always shown in the App before purchase, and exact feature availability and limits may vary by platform and app version.

5.2 Billing & Auto-Renewal

Subscriptions are billed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You may manage your subscription and turn off auto-renewal by going to your device's Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5.3 Refunds

Refund requests are handled in accordance with Apple App Store and Google Play Store policies. For an App Store purchase, request a refund from Apple. For a Google Play purchase, use Google Play's refund process or contact us; eligibility depends on the purchase and the store's applicable rules. We never hold your payment details.

6.Acceptable Use

You agree NOT to:

• Use the App as a substitute for professional medical advice, diagnosis, or treatment
• Rely solely on AI-generated nutritional estimates for managing serious health conditions
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
• Circumvent, disable, or interfere with security features or premium feature restrictions
• Attempt to gain unauthorized access to any systems or infrastructure connected to the App
• Use the App to transmit harmful, offensive, or illegal content
• Share your account credentials with others or allow multiple people to use a single account
• Use automated means to access or interact with the App (bots, scrapers, etc.)

7.Health & Medical Disclaimer

You acknowledge and agree that:

• Intended Use — Not Medical Advice: BodyDex is intended for tracking and general information. Do not use its content to diagnose or treat a condition, or to select, start, stop, or change a dose of any medication, supplement, or peptide. All calorie calculations, macro targets, and nutritional estimates are based on general formulas (such as Mifflin-St Jeor) and are approximations only. Individual results may vary.
• Consult Professionals: You should always consult a qualified healthcare professional, licensed dietitian, or physician before starting any new diet, exercise program, supplement regimen, or making changes to your medication.
• AI Limitations: AI-powered food analysis provides estimates only. Accuracy depends on image quality, food presentation, portion sizing, and model capabilities. Bodydex Assistant responses and other AI output may be inaccurate, incomplete, or inappropriate for you, and are not a substitute for professional nutritional counseling or medical care.
• AI-Generated Visual References: Exercise demonstration images, anatomical illustrations, muscle-recovery visualizations, and any other visual guides shown within the App are computer-generated for illustrative reference only. They may not depict every nuance of correct form, full range of motion, proper bracing, or safe load progression for any individual user. You should consult a certified personal trainer, physical therapist, or coach for proper exercise technique, especially for compound lifts, advanced movements, rehabilitation work, or any exercise that involves significant load.
• Exercise & Physical Activity Risk: All physical exercise carries an inherent risk of musculoskeletal injury, cardiovascular strain, and other physical harm. You voluntarily assume all such risks when performing any workout, routine, exercise, or movement tracked, suggested, or visualized through the App. Stop any movement that causes pain or discomfort and seek qualified medical attention if injured. Do not begin a workout program without medical clearance if you have a pre-existing condition, cardiovascular concern, musculoskeletal injury, or are pregnant.
• User Responsibility: You are solely responsible for all health decisions made in connection with information obtained from the App.
• Not for Emergencies: The App is not intended for use in medical emergencies. If you experience a medical emergency, call your local emergency services immediately.

8.Protocol, Medication & Supplement Tracking Disclaimer

You acknowledge and agree that:

• No Endorsement of Substances: The inclusion, listing, or tracking of any medication, supplement, peptide, or other substance within the App does NOT constitute an endorsement, recommendation, or validation of that substance by BodyDex or its developer, and is not a suggestion to obtain or use it. No feature of the App is intended to suggest that you take, obtain, or use any substance; if any output, including AI output, appears to do so, treat it as an error and do not rely on it.
• Research Library Is Educational Only: The Research Library and any compound descriptions, dosage figures, cycle information, or preset values shown in the App are informational and educational reference material only. They describe published or commonly reported use for context; they are NOT instructions, prescriptions, dosage recommendations, or treatment guidance, and they must be independently verified with a licensed healthcare provider.
• Sources & Citations Are Not Endorsements: Scientific citations, regulatory labels, reliability indicators, and external links displayed in the App are provided solely for educational reference so you can read further. They do NOT constitute an endorsement of any compound, a claim of safety or efficacy, or a recommendation to use any substance, and BodyDex does not guarantee the accuracy, completeness, or conclusions of any cited third-party source.
• Regulatory & Legal Status: Many substances available for tracking are not approved by the U.S. Food and Drug Administration (FDA) or equivalent regulatory agencies for the described or any use, are investigational or research-grade, or may be illegal to purchase, possess, or use without a valid prescription in your jurisdiction. BodyDex takes no position on the legality, availability, safety, or efficacy of any substance.
• Peptide Calculator: The peptide reconstitution calculator converts the values you enter. It does not determine an appropriate substance, dose, concentration, or administration method for you, and it is not intended to provide medical instruction, injection training, or dosing guidance. Have those decisions and the resulting calculation checked by a qualified healthcare professional. Any instructional text displayed is general reference information only.
• User Responsibility: You are solely responsible for ensuring that any substances you track are legal in your jurisdiction, used in accordance with applicable laws and regulations, and administered under the supervision of a licensed healthcare provider.
• No Drug Interaction Checks: The App does NOT verify drug interactions, contraindications, allergies, or dosage safety. You must consult your healthcare provider and pharmacist for all drug interaction and safety information.
• Liability: To the maximum extent permitted by applicable law, the developer is not liable for any adverse health outcomes resulting from self-administration of any substance tracked or calculated using the App (see Sections 14 and 22.5).

9.AI Features: Important Limitations and Responsibility

9.1 What the AI features do

Bodydex uses artificial intelligence to organise information you have recorded, interpret what you enter, estimate nutrition from a photo or a spoken description, summarise your own records, present general information, and propose entries or actions inside the App. Responses may be personalised using information you supplied and information the App's data-access settings make available to the feature. Personalisation does not make a response a professional assessment of you. It means the model was given more of your own data, not that anyone qualified has looked at it.

9.2 No professional relationship

Neither Bodydex nor its operator, Daniel Bobunov, acts as your physician, pharmacist, dietitian, nurse, trainer or any other licensed healthcare professional through these features. Using an AI feature does not create a healthcare-provider relationship, and nothing produced by one is a prescription, a diagnosis, a treatment plan, or individualised medical advice. The features are not a substitute for professional diagnosis, treatment, prescribing, or individualised advice from someone who can examine you.

9.3 AI can be wrong, including confidently wrong

AI-generated text, estimates, summaries, citations and proposed entries may be inaccurate, incomplete, out of date, or unsuitable for your circumstances, and may be expressed in confident, fluent language while being wrong. A result may also be wrong because the records it was built from were wrong or incomplete. A substance being named, a dose being displayed because you recorded it, or a research source being cited does not establish that the substance, the dose or the use is safe, effective, lawful or appropriate for you. Nutritional values, calorie and macronutrient figures, recovery estimates and projections are estimates from general formulas and visual analysis, not measurements.

You are interacting with an automated artificial-intelligence system, not a human. The App identifies these features as AI-powered at the point of use, and the Bodydex Assistant states that it is an AI when you set it up and carries a persistent notice in its chat screen. This disclosure is provided in line with applicable AI transparency laws, including Article 50 of the EU Artificial Intelligence Act.

9.4 Health decisions require your own and a professional's judgment

Do not use an AI response to decide whether to start, stop, or change a medication, supplement, peptide or treatment, or to work out an individualised dose. Discuss those decisions with a qualified healthcare professional, and do not delay seeking professional care because of something an AI feature told you. The AI features are not an emergency service and are not designed for companionship, emotional support, therapy, counselling or mental-health care. If you are in crisis or thinking about harming yourself, stop using the App and contact your local emergency services — in the United States, call 911, or call or text 988 for the Suicide & Crisis Lifeline.

9.5 Entries and actions the AI proposes

Check AI-generated entries and proposed changes against what you actually intended to record. Depending on the automation setting you choose for the Assistant, some supported actions may be applied automatically rather than waiting for you to confirm each one; logging a dose always requires your confirmation. Recording or confirming an entry records information; it does not validate it medically and does not mean the underlying action is safe or advisable for you.

9.6 Liability for the AI features, and the rights you keep

Subject to the rights and responsibilities that applicable law does not allow us to exclude, we do not warrant that AI output will be accurate, complete, or suitable for any particular decision, and we are not liable for loss or harm arising from a decision you make in reliance on it. Claims concerning the AI features are subject to the limitations in Section 14 and the indemnity in Section 15, in each case only to the extent those provisions are lawful.

What this section does not do. Nothing in it excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing in it requires you to waive a statutory consumer guarantee or a data-protection right, and nothing in it asks a consumer to indemnify us for ordinary use of the App or for a health outcome arising from it. Where the exclusions in this section and the protections in Section 14 or 15 differ, the reading that preserves your non-excludable rights applies.

9.7 What is sent, to whom, and for how long

You acknowledge and agree that:

• Explicit Consent Before Health Data Is Sent: The Assistant does not run until you give explicit consent in the App to the processing described in Privacy Policy Section 6.2, including the sending of health data to OpenAI through our server proxy. You can withdraw that consent at any time (Privacy Policy Section 11.7).
• Estimates Only: All AI-generated nutritional information (calories, macronutrients, portion sizes) are estimates and approximations. They should NOT be relied upon as exact values.
• Two Retention Layers, Not One: On our own servers, food photos, voice audio and text submitted for AI analysis are processed and then discarded, with the narrow exceptions described in the Privacy Policy (Sections 6.1, 6.2 and 6.4): scan-accuracy report photos you explicitly choose to send (deleted within 90 days), video-import delivery records (deleted within 7 days), and a working copy of an Assistant reply that paused mid-answer, whose content we attempt to clear as soon as the reply finishes and which we otherwise attempt to remove on the criteria Privacy Policy Section 6.2 sets out, where a failed attempt can leave it in place longer. Separately, our AI providers may retain what we send them under their own terms after we have discarded our copy; for the Assistant, OpenAI states a default abuse-monitoring retention of up to 30 days, longer where its stated exceptions apply, and we have not arranged zero-data-retention (Privacy Policy Section 6.2).
• AI Training Disclosure: OpenAI states that content sent through its API is not used to train its models unless the customer opts in, and we have not opted in. Food images, audio clips, and nutritional text prompts sent to our other AI providers may be used by them for model improvement in accordance with their respective terms. We do not attach your name or email address to any of these submissions, but content you submit — a photo, a message, a note — may itself contain identifying information.
• What Accompanies an AI Request: Each request carries what its feature sends — a food photo, a short text query, a voice clip and, for the Assistant, the personalisation context that accompanies every message together with anything the Assistant reads on demand, all of it itemised in Privacy Policy Section 6.2 and bounded by the data-access categories you grant. Requests are keyed to a pseudonymous identifier. Your profile name and email address are never attached automatically — though a message, note or photo you submit can itself contain identifying information, and we cannot remove it for you.
• Service Availability: AI features require an active internet connection and are subject to third-party service availability. We do not guarantee uninterrupted access to AI features.

10.Data Accuracy & Third-Party Data Sources

Nutritional data within the App is sourced from third-party providers and databases. While we strive for accuracy, we do not independently verify all nutritional data and cannot guarantee that it is complete, accurate, or up to date.

You acknowledge that nutritional data from the following sources may contain inaccuracies:

• FatSecret Platform API — BodyDex is powered by data from the FatSecret Platform API. Use of FatSecret data is subject to the FatSecret Terms of Use.
• USDA FoodData Central — Government-provided nutritional reference data (public domain).
• Open Food Facts — Community-contributed food database used under the Open Database License (ODbL).

You should independently verify critical dietary information, particularly if you have food allergies, intolerances, or medical conditions that require precise nutritional management.

11.Intellectual Property

All content, features, functionality, design, code, trademarks, and visual elements of the App (excluding user-generated content and third-party data) are the exclusive property of Daniel Bobunov and are protected by applicable intellectual property laws.

Third-party data sources (USDA, Open Food Facts, FatSecret) are used under their respective licenses and remain the property of their respective owners.

12.User-Generated Content

You retain full ownership of all content you create within the App, including but not limited to: recipes, food log notes, weight log notes, custom exercises, and any other user-entered data.

We do not claim any ownership rights over your content. Your user-generated content is stored locally on your device and is not shared with, transmitted to, or accessed by us or any third party unless you explicitly initiate such action (e.g., using AI analysis features).

13.Feedback & Suggestions

If you provide us with any feedback, suggestions, ideas, or feature requests ("Feedback"), you acknowledge that such Feedback is provided voluntarily, and you permit us to use, modify, and implement nonpersonal suggestions in it to improve BodyDex, without attribution or compensation. Personal information in Feedback remains subject to our Privacy Policy and your applicable privacy rights.

14.Limitation of Liability

To the maximum extent permitted by applicable law:

• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any warranty exclusions apply only where permitted by law; mandatory consumer guarantees remain unaffected.
• We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• In no event shall Daniel Bobunov be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or health outcomes, arising from your use of or inability to use the App.
• Our total aggregate liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you have paid to us in subscription fees in the twelve (12) months prior to the event giving rise to the claim, or fifty US dollars ($50.00), whichever is greater.

Inaccuracies in nutritional data provided by third-party sources, health outcomes from following app-generated targets, data loss due to device failure, and service interruptions due to causes beyond our reasonable control are events for which responsibility is determined under applicable law and the enforceable limitations in this section.

What this section cannot do (Section 22.5, restated here so it is not missed). Every exclusion and cap above applies only so far as the law allows. Nothing in this section excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited, and nothing in it removes a mandatory consumer guarantee or a statutory data-protection right. The in-app disclaimer screens summarise these Terms; where a summary reads more broadly than this section, this section and Section 22.5 govern.

Local data cannot be recovered by us. Because your tracking data is stored only on your device (see the Privacy Policy), we have no copy of it and cannot restore it if the App is uninstalled or your device is lost, reset, or damaged. The App's export feature (Profile → Export Data) produces a portable copy of your records in JSON and CSV formats; it is a data copy, not a restorable in-app backup, and does not include image files or certain settings. Device-level backups, where you have enabled them, follow your platform's controls.

15.Indemnification

You agree to indemnify, defend, and hold harmless Daniel Bobunov and any affiliated parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your misuse of the App in breach of these Terms
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any content, data, or information you submit to or through the App

Consumer users are not required to indemnify us merely for ordinary use of the App or a resulting health outcome, and this indemnity does not extend beyond the four items listed above. The in-app disclaimer you accept before using protocol tracking refers to this section; where its wording reads more broadly, this section governs, and Section 22.5 applies to it as well.

16.Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or infrastructure outages, third-party API provider downtime, power failures, cyberattacks, pandemics, or other force majeure events.

As an individually operated service, we will make commercially reasonable efforts to restore functionality following any such event, but cannot guarantee specific timelines for resolution.

17.Dispute Resolution & Arbitration

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles.

17.2 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at Click to reveal email and attempt to resolve the dispute informally for at least thirty (30) days.

17.3 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA) or a comparable arbitration body.

17.4 Class Action Waiver

17.5 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

18.Apple App Store & Google Play Store Terms

18.1 Apple App Store

If you access the App through the Apple App Store, the following additional terms apply:

• These Terms are between you and Daniel Bobunov only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• The license granted to you for the App is limited to a non-transferable right to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the App.
• Apple is not responsible for addressing any claims relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Apple shall not be responsible for the investigation, defense, settlement, or discharge of such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18.2 Google Play Store

If you access the App through the Google Play Store, you acknowledge that Google LLC is not a party to these Terms and has no responsibility or liability for the App. In the event of a conflict between these Terms and the Google Play Developer Distribution Agreement, the Google Play Developer Distribution Agreement shall prevail.

18.3 Subscription Billing

All subscription purchases and in-app transactions are processed through the respective app store (Apple or Google). We do not have access to your payment information (credit card numbers, billing addresses). Payment disputes should be directed to the respective app store.

19.Electronic Communications

By using the App and enabling push notifications, you consent to receiving electronic communications from us, including but not limited to:

• Medication, supplement, and meal logging reminders (user-configured)
• Important service announcements and updates
• In-app notifications regarding your account or subscription

You may disable push notifications at any time through your device settings.

20.Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.

You may stop using the App at any time. You may delete the data stored on your device at any time through the App's settings (Profile → Delete All Data); this permanently and irreversibly removes all locally stored data and signs you out. Certain limited server-side records (described in the Privacy Policy — for example feedback you submitted, subscription records managed by Apple, Google, and RevenueCat, and short-lived operational records) are retained per the schedules stated there, and data the App previously wrote to Apple Health or Health Connect remains in those apps under your control.

21.Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. It is your responsibility to review these Terms periodically for changes.

Your continued use of the App after any modifications to these Terms constitutes your acceptance of the modified Terms.

22.General Provisions

22.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

22.3 Assignment

We may assign or transfer our rights and obligations under these Terms without restriction (including in connection with the formation of a business entity or sale of assets). You may not assign or transfer your rights under these Terms without our prior written consent.

22.4 Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription terms, constitute the entire agreement between you and Daniel Bobunov regarding your use of the App.

22.5 Non-Waivable Rights

Nothing in these Terms excludes or limits any rights you have, or any liability we may have, that cannot lawfully be excluded or limited under applicable law.
